Entry Terms & Conditions and Participant Waiver

Please read carefully before you enter. By entering, you agree to these terms.

1.Definitions

“Organiser”, “we”, “us”, “our”
Mighty Events Limited.
“Series”
The Takapuna Beach Series for the 2026/27 season: 8 Events, plus up to 4 reserve dates.
“Event”
One of the 8 scheduled race evenings that make up the Series.
“Race”
An individual race you enter at an Event — a discipline and distance from the table in section 2.
“Category”
Either the Adult category (aged 13 and over) or the Kids category (aged 12 and under).
“Series pass”
A Full Series pass or a Half Series pass, as described in section 9.
“Event Party”
The Organiser and its directors, officers, employees, contractors, agents and volunteers (including medical and paramedical personnel), the Series promoters and partners, the owners, licensees and occupiers of land or water on which any Event is held, and any statutory body or local authority with control over that land or water.
“you”, “your”
The person entering the Series, or, where an entry is made for a person under 18, both that person and their parent or legal guardian.

By entering the Series, you agree to these terms.

2.Races, categories and competency

2.1 Races

Swim

Adult500 m, 1,000 m, 1,500 m, 2,000 m Kids250 m

Stand-up paddleboard (SUP)

Adult1.5 km, 3 km, 4 km Kidsnot offered

Beach run

Adult5 km Kids2.5 km

Adult is the 13-and-over Category; Kids is the 12-and-under Category. There is no Kids SUP Race.

2.2 Your Category is determined by your age as at 3 November 2026, the first Event of the season.

2.3 Swim competency

You confirm you can meet the following standard, in open water, unassisted and without touching the bottom:

Any swim Race
The full distance of the Race you have entered, continuously
Any SUP Race
500 metres continuously
Beach run
No swim competency required

We require a swim competency declaration for SUP Races because paddlers come off their boards, sometimes a long way from shore.

2.4 Fitness and preparation

  1. You must not compete unless you have trained and prepared appropriately for the Race you have entered.
  2. You confirm that either a medical practitioner has confirmed you are fit to take part, or you reasonably believe you are sufficiently fit and healthy to do so.
  3. You must tell us at registration about any medical condition, medication or impairment that could affect your safety, or the safety of others, on the water or on the course. We keep this confidential and use it only for safety and emergency purposes.
  4. You must give us a current emergency contact and keep it up to date.

3.Risks you accept

3.1 The Series takes place in the open sea and on public beaches and reserves. It carries a real risk of serious injury or death.

3.2 You acknowledge and accept those risks, which include but are not limited to:

In the water — drowning; rips, currents, tides and surf; cold water shock and hypothermia; disorientation and loss of visibility; separation from your board; collision with other swimmers, paddlers, boards, boats or craft; entanglement; marine life including jellyfish; water quality and contamination, particularly after heavy rain; and delay in a rescue reaching you.

On land — falls on sand, rock or uneven ground; collision with other competitors, members of the public or vehicles; and hazards or objects on the beach or course.

Physical — overexertion; cardiac events; heat illness; dehydration; sunburn; and pre-existing conditions being aggravated.

Other — equipment failure; the acts or omissions of other participants, spectators or third parties; and delay or limitation in medical assistance.

3.3 You accept that conditions can change quickly, and that a course that was safe at briefing may not be safe by the time you start.

4.Safety, briefings and directions

4.1 You must read the Event Safety Briefing and the Rules & Regulations, attend and listen to all compulsory pre-event safety briefings, and immediately ask an event official about anything you do not fully understand.

4.2 You must follow all reasonable directions given by us, event officials, contractors, employees and volunteers, and by any lifeguard, surf patrol, harbourmaster or emergency services personnel.

4.3 Mandatory equipment.

  1. Swim Races — you must wear the supplied bright swim cap. Wetsuits are optional in every Race, at every water temperature. Deciding whether to wear one is your choice, and you should make it with the conditions on the day and your own tolerance for cold in mind.
  2. SUP Races — you must wear a leash at all times on the water. Personal flotation device requirements are set out in the Event Safety Briefing, and you must follow them. Your board must be in sound condition and appropriate for the conditions.

4.4 If you withdraw during a Race, you must report to an event official, the finish tent or the registration desk as soon as you safely can. If you do not, we may treat you as missing and start a search. You may be charged the reasonable costs of an unnecessary search caused by your failure to report.

4.5 The course closes at 7:30pm. You must finish before then, and if you are still on course at that time you must leave it if directed.

4.6 The safety measures we provide — course supervision, water safety craft, briefings, medical presence — are a service to you and other competitors. They are not a guarantee of your safety.

5.Our right to refuse or remove you

5.1 We may refuse your entry, remove you from a course, or exclude you from the Series if, acting reasonably, we consider that you:

  1. are not fit or competent to complete your Race safely;
  2. are affected by alcohol or drugs;
  3. are ignoring safety directions or event rules;
  4. are behaving in a way that is dangerous, abusive or threatening toward any participant, official, volunteer or member of the public; or
  5. will not finish before the course closes.

5.2 A decision under clause 5.1 does not entitle you to a refund, except where we have acted unreasonably.

5.3 You must treat officials, volunteers, other competitors and members of the public with respect at all times.

6.Medical treatment

6.1 You consent to receiving first aid and medical treatment from qualified event medical personnel during or after an Event.

6.2 If you are unable to consent for yourself, you authorise us to arrange ambulance transport and medical treatment on your behalf.

6.3 You are responsible for the cost of any ambulance transport, hospital treatment or medical care you receive.

7.Release and limitation of liability

7.1 You take part voluntarily and accept the risks described in section 3.

7.2 To the maximum extent permitted by law, you release each member of the Event Party from all claims, demands and proceedings arising out of or connected with your participation in the Series, including claims arising from their negligence.

7.3 This release continues indefinitely and binds your heirs, executors, personal representatives and assigns.

7.4 Nothing in these terms limits or excludes:

  1. any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other legislation, to the extent that right cannot lawfully be excluded;
  2. any duty owed under the Health and Safety at Work Act 2015; or
  3. any liability that cannot lawfully be limited or excluded.

7.5 Insurance. Your entry fee does not include personal accident, medical, travel or property insurance. We recommend you hold your own. Your entry does not insure your board, wetsuit or other equipment.

7.6 Your possessions. You are responsible for the security of your personal possessions at all times. We are not liable for loss of or damage to them.

8.Timing straps and results

8.1 You must wear a timing strap to compete. It is your responsibility to make sure it is fitted correctly before your Race starts.

8.2 You must not swap or share your timing strap with another participant. Doing so may void your result and lead to exclusion from the Series.

8.3 Timing straps remain our property.

8.4 If you do not return your timing strap — after each Event if you have entered a single Event, or at the end of the season if you hold a Series pass — or if you lose it, you must pay a replacement fee of $50 (incl. GST). We will invoice you and payment is due within 21 days.

8.5 If you intend to compete in a Race other than your default Race, you must tell registration staff before that Race starts. If you do not, your time will be removed and no Series points will be awarded for that Race.

8.6 We take reasonable care with timing but do not guarantee the accuracy of any result. Results protests must be made in writing to info@beachseries.co.nz within 7 days of results being published.

9.Entries, fees, changes and cancellation

The Series calendar

9.1 The Series is made up of 8 Events, with up to 4 reserve dates held in case an Event cannot go ahead. The first Event is on 3 November 2026. The full calendar is published at beachseries.co.nz/pages/dates.

Single-Event entries and Series passes

9.2 If you buy a single-Event entry, you may use it at any one of the 8 Events. You do not have to nominate which one in advance, and it does not expire if you miss a particular Event.

9.3 If you buy a Full Series pass, it covers you for all 8 Events. A Half Series pass covers you for any 4 of the 8 Events — you do not have to nominate which 4 in advance.

Changing your Race

9.4 You may enter a different Race at each Event — you are not locked into one discipline or distance for the season. Two things follow:

  1. if you move up to a longer or higher-priced Race, you must pay the difference in entry fee before you start; and
  2. if you move down to a shorter or lower-priced Race, no refund or credit is payable.

You must still tell registration staff before the Race starts — see clause 8.5.

Discounts

9.5 Discounts and promotional codes cannot be combined. Where more than one applies, the highest-value code you are eligible for will be applied.

Changes to an Event

9.6 Circumstances beyond our control may make it necessary or desirable to change the format, location, date, distance or course of an Event — including shortening a course, or substituting a beach run for a water Race on safety grounds. You consent to those changes, and these terms apply to the changed Event.

If we cannot hold an Event

9.7 If we cannot hold an Event because of weather, sea conditions, water quality or contamination, natural disaster, public health direction, direction of a local authority, harbourmaster or emergency services, or any other cause beyond our reasonable control:

  1. we will first try to run it on one of the reserve dates;
  2. if you hold a single-Event entry, it stays valid and you can use it at any remaining Event in the season; and
  3. if you hold a Series pass and we do not hold enough Events across the season and its reserve dates for you to use it in full — 8 Events for a Full Series pass, or 4 for a Half Series pass — we will credit you the value of the Events you could not use against your entry for the following season.

If you withdraw from the Series

9.8 If you tell us in writing at least 7 days before the first Event — that is, by 27 October 2026 — we will refund your entry less an administration fee of 20% of the amount you paid. After that date, entry fees are not refundable.

9.9 Entries cannot be transferred to another person this season.

9.10 We set these terms because we commit to significant costs — timing, medical and water safety, permits, venue, insurance, equipment hire and prizes — well in advance of the season.

10.Photography, filming and drones

10.1 We and our contractors will photograph and film the Series. You consent to us using your name, image, likeness and result before, during and after each Event to promote, broadcast and report on the Series, in any media, without payment.

10.2 You consent to a drone being flown above or around you for filming and promotional purposes.

10.3 If you have a genuine reason to be excluded from promotional imagery, get in touch (see section 14.4) before your first Event and we will do our best to accommodate you. We cannot guarantee removal from wide crowd or aerial shots.

11.Your personal information

11.1 Mighty Events Limited collects your personal information to register you, run the Series, publish results, contact you about the Series, and respond to emergencies.

11.2 We do not sell or pass your contact details on to third parties for marketing. We share your information only with our timing provider, our official photographer, our medical and water safety providers, and emergency services where needed.

11.3 Your name, age group, club and results will be published on the Series website and on results platforms.

11.4 We hold your information in New Zealand. We keep it indefinitely so that you and other competitors can look back at Series results from previous seasons — many people want to track their times over the years. If you would rather we did not, ask us and we will remove your information.

11.5 You have the right to ask for access to, and correction of, the personal information we hold about you. Get in touch using the details in section 14.4.

12.Entries by people under 18

12.1 You must be 18 or over to enter on your own behalf.

12.2 If you are under 18, your parent or legal guardian must review and agree to these terms on your behalf. By doing so, they:

  1. consent to your participation in the Series;
  2. confirm you are confident and capable of completing the Race you have entered, and that you meet the swim competency standard in clause 2.3;
  3. agree to these terms in their own right; and
  4. accept responsibility for supervising you at each Event.

12.3 A parent or legal guardian, or another responsible adult nominated by them, must be present at the Event and must supervise any competitor in the Kids category at all times when that competitor is not on course.

12.4 Adults accompanying a child in the water. If you swim or paddle alongside a child, you agree to these terms on your own behalf and confirm you have authority to agree to them on the child's behalf. You are responsible for that child's supervision in the water at all times.

13.Entering on behalf of someone else

If you enter, or agree to these terms, for another person — including a child, a relay team or a family entry — you confirm you have their authority to do so and that you have brought these terms to their attention.

14.General

14.1 Governing law. These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

14.2 Severability. If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.

14.3 Changes to these terms. We may update these terms between seasons. The version that applies to you is the one you accepted at entry, except where a change is needed for safety or legal compliance.
